Constitution

Education Journalists' Group is run under a democratic statute where various aspects of the organization conduction are provided. The Working Committee as well as the office administration is solely based on the provisions of the Statute. The Statute has underlined organizational objectives, membership types, and criteria, General Assembly and Working Committee, rights, duties and functions of the members in the Working Committee, financial management and other relevant aspects.

Preamble

 

Education Journalists' Group is formed on the participation of different media's journalists acknowledging the fact that it is essential to give information to public people and policy makers through media by conducting depth study, research, news reporting, and article to ensure the betterment of education policy and educational condition.

 

Chapter 1

Preliminary

1. Short title and commencement

  • The name of institution will be 'Shiksha Patrakar Samuha'. In may be abbreviated as Shi Pa Sa in Nepali.
  • It will be called "Education Journalists' Group" in English.
  • This statute will come into force right after the date of registration of the institution.

2. Definition:

  • 'Group' denotes Education Journalists' Group
  • 'Statute' means the statute of Education Journalists' Group.
  • 'Journalist' means the journalist being involved in legal news media and freelancing journalist.
  • 'Rule' means codes of rules prepared by Working Committee in accordance with the clause 25 of Group's statute.
  • 'General Assembly' means the General Assembly formed in accordance with clause 10 of this statute.
  • 'Session' means the session of General Assembly.
  • 'Clause' and 'sub clause' means the clause and sub clause of this statute.
  • Working Committee means the Working Committee formed in accordance with clause 13 of this statute.
  • 'Fixation' or 'Fixed accordance with' means Fixed by rule.
  • 'Local officer' means chief district officer of concerning district.

3. Sign and stamp of institution:

The Group will have its own sign and stamp.

 

4. Office of Institution:

  • The office of Group will be located at any place of Kathmandu district, as per the decision made by Working Committee.
  • The Group may work in other districts outside valley by opening branch-offices taking necessary permission.
  • The relocation of the office of the Group will be informed to local officer.


 

Objectives

5. Objective of Group: Objective of the Group will be as following:

  • To inform public and policy makers through print and electronic media by airing and writing news, article and news report related to education
  • To conduct seminar and interaction program on the type of appropriate educational environment
  • To help policy makers and experts for making educational policies through article having depth study including other research study
  • To carry out comparative study about educational policy and experience of neighboring and third world countries; and to suggest in accordance with our relevance
  • To undertake study on different field of education with the help of concerned experts
  • To endeavor as much as possible to make government's vocational and scientific educational program successful

Chapter 3

Membership

6. Qualification of member: Nepalese citizen of following criteria are eligible to become member of the Group.

  • S/he must be at least eighteen years of age.
  • The person must be affiliated in news media taking journalism as profession or working as freelance journalist. But this rule does not apply in case of honorable membership.
  • S/he must not be disqualified by prevalent Laws.

7. Kind of membership: The member of the Group will be of three types as mentioned below:

  • Full member: The person working in the field of education in journalism for at least one year can be full member. But, full membership will not be granted to anyone without becoming assistant member.
  • Assistant member: Assistant membership will be given to those journalists working at least for one year in media. The journalist who has worked honestly for 6 months with commitment to meet the objective and program of the Group will be eligible to become full member.
  • Honorable member: Honorable membership may be granted to those people, both Nepali and foreigners, who have made significant contribution towards the objective of the Group or to those renowned in education field or to the education expert.

8. Membership fee and method to provide membership:

  • Qualified journalists in accordance with clause 6 may apply for membership of the Group.
  • By charging fixed membership fee, the meeting of Working Committee may grant membership to the applicant in accordance to the Sub-clause (i).
  • Full or assistant member need to renew their membership every year. In case of the failure of renewal after three months of validity, the membership will be collapsed automatically.

9. Disqualifications of members

(a) In the following condition, the membership of any person will be dismissed.

    • If S/he dies
    • If S/he resigns from membership
    • If S/he abandons the profession of journalism completely
    • If S/he works against the advantage of Group
    • If S/he does not renew membership

(b) Any member found working in accordance with sub clause (iv), will be dismissed by the unanimous decision of Working Committee. But, the chance will be given to those members to give clarification before their dismissal from Group.

General Assembly and Working Committee

10. Constitution (formation) of General Assembly

    • There will be all full members in General Assembly of Group. Assistant and honorable members may take part in session as an observer,
    • General Secretary will inform about session of General Assembly before 15 days by means of written or public notice.

11. Session of General Assembly

    • Generally, the session of General Assembly will be called (summoned) by every year's end
    • Attendance of at least fifty-one percent members will be considered a must for the session of General Assembly.
    • One-third members may call the special session of General Assembly in case of the need of taking prompt decision, by giving written reasons to chairman about the purpose of calling session.

12. Functions, Duties and Powers of the General Assembly:

  • Functions, Duties and powers of General Assembly will be as given below in accordance with this statue:
    • To discuss upon the report of Working Committee and to approve if seen appropriate
    • To approve/pass new programs for the achievement of Group's objective
    • To approve agreements made by Working Committee with governmental and non-governmental organizations.
    • To accept the actuality of the economic report of income a expenditure by discussing it and approve annual budget.
    • To conduct election of Working Committee
    • To do other necessary works which do not go against statute
    • To conduct election for vacant seat if any of Working Committee

13. Formation of Working Committee:

There will be eleven members in the Working Committee including Chairman, Vice-chairman, General Secretary, Secretary, Treasurer and other 6 members who are elected by majority of the General Assembly.

 

14. Meeting of Working Committee

(i) The meeting of Working Committee will be called at least once in every month

(ii) The meeting of Working Committee will be called time to time as per the need

(iii) Fifty-one percent will be the quorum for Working Committee's meeting

(iv) The decision will be made from simple majority except in the the case where it is specified.

 

15. Functions, Duties and Powers of Working Committee

Functions, Duties and Powers of Working Committee will be as given below:

(i) To implement the proposal that is approved by General Assembly

(ii) To prepare and submit the annual progress report in General Assembly

(iii) To submit the annual income and expenditure report of previous year and budget for next year

(iv) To submit the agreements made with governmental and non-governmental agencies in General Assembly for their approval

(v) To do other necessary works to meet the objectives of the Group

(vi) To constitute necessary sub-committees to increase the working capacity of Group

(vii) To nominate the advisors as per the necessities to fulfill the objective of Group

Chapter 5

 

Functions, Duties and Power of Executive committee

16. Functions Duties and powers of Officers: Functions, Duties and powers of given members of Group will be as follows:

 

a) Chairman:

(i) To hold chairmanship of Working Committee's meeting or General Assembly.

(ii) To give deciding vote in case of draw in election.

(iii) To instruct and care in the different activities of Group.

(iv) To fulfill responsibility given by Working Committee or General Assembly.

(v) He may take 10 thousand Rupees at one time with the permission of treasurer but it must be later approved from Working Committee's meeting.

(vi) To do other necessary executive works those do not to go against statute.

b) Vice-chairman:

(i) to chair Working Committee's meeting or General Assembly's meeting in the absence of chairman.

(ii) to assist in the work of chairman.

(iii) to do all the executive works of chairman in absence of him/her.

c) General Secretary

(i) General Secretary will be responsible for conducting daily works and running all office activities. Yet, Working Committee may provide special management to bear this responsibility.

(ii) Calling the Working Committee's meeting as per chairman's instruction.

(iii) Approving officially the decision made by Group.

(iv) Conducting the daily functions of Group.

(v) Doing works as per instruction given by chairman.

(vi) Taking responsibility as member secretary in the session of General Assembly.

(vii) Doing other necessary as mentioned in the statute of Group.

d) Secretary

(i) To call the meeting of Working Committee in the absence of General- Secretary.

(ii) To do all the works of General Secretary in the absence of General Secretary or if this post remains vacant.

(iii) To help in the work of General Secretary

(iv) To do all the other necessary works.

e) Treasurer

(i) To keep all the accounts of income and expenditure.

(ii) To prepare and submit the financial report and budget to Working Committee

in accordance with the consultation given by chairman and general secretary.

(iii) To do all the other assigned works.

f) Member

(i) To do works for Group's benefit by using the rights provided by statute.

(ii) To do all the other assigned works.

Financial Management

17. Financial Sources

a) Financial sources of the Group will be accordance to the following:

(i) The amount from membership of Group and its renewal.

(ii) Funds obtained from governmental, non-governmental or from any individual or any other legal income.

(iii) The amount obtained from conducting any kind of program.

(iv) The amount given by donor agencies accordance with their agreement with Group to conduct any kind of program.

b) All the financial procedures of Group will be kept in accordance with the generally accepted principles of accounting system.

c) Pre-permission of government will be taken in case of receiving foreign aid of any kind.

18. Account of movable and immovable property

a) Accounts of movable and immovable property of Group will be kept fair by Working Committee.

b) General Secretary and treasurer will take the responsibility of submitting details about movable and immovable property of Group if asked by concerned authority.

c) Group will be authorized to buy and sell or to give in rent of their movable and immovable property as an individual does.

 

19. Fund

a) The fund of Group will be conducted by opening account in local bank and the account will be conducted with the joint signature of chairman or general secretary and treasurer of Working Committee. But, separate account may be opened in any member and treasure's joint signature if the Working Committee thinks appropriate to it.

b) The treasure will inform to chairman about obtaining fund from any source in accordance to clause by collecting within seven days.

20. Audit

a) All the financial transactions including annual income and expenditure of Group will be audited by a registered auditor.

b) One copy of audit report will be submitted to local officer in every year.

Chapter 7

Miscellaneous

21. Election System

a) There will be election in every two years for all the post of Working Committee in a democratic way. For the first time the election will be within the six months.

b) A election commission of three members among the member of General Assembly will be constituted. This commission may manage itself other activities related to election.

c) No one shall be elected without obtaining at least fifty-one percent vote for all the post of Working Committee.

d) Re-election will be held in the case of votes acquired is less than fifty-one percent in accordance with sub-clause (iii). It will be informed to local officer after election.

e) Those members of the Working Committee or other members will be automatically dismissed from his or her post if he/she is not attending Working Committees' meeting continuously for three times without giving information.

f) Election will not be conducted for any vacant post if the time for the next election of the Working Committee is less than 6 months.

g) Any member bearing the responsibility of the same post for two consecutive years will not be able to be the candidate and elected in the same post for third time. However, this will not be applicable in case of general member.

22. No Confidence Motion

a) One third member of General Assembly may file the motion of no confidence against Working Committee or its other members during the session of General Assembly.

b) The member of Working Committee and other members will be dismissed with the motion in accordance to sub clause (a) with the two third majority of the General Assembly.

c) Re-election will be held for remaining period of Working Committee, if the motion in accordance with sub clause (b) is resolved. This kind of election system will be in accordance with clause 21.

23. Amendment of Statute

a) One third member of Group may submit a proposal of amendment of Statute in General Assembly if they see it necessary.

b) Two third member of General Assembly will approve the proposal in accordance with sub clause (a) if they find it convincing. The amendment of the statute will be enforced by taking the permission of local officer.

24. Making Rules

a) Working Committee will make the rules for the effective implementation of statute. This kinds of rules will be approved from General Assembly.

25. Dissolution of institution

a) The institution may be dissolved with two third majority of the members of the General Assembly if deemed necessary.

b) All the property of Group will be used as per the prevalent law of Nepal if the institution is dissolved accordance with sub clause (a).

26. Progress report of every four month

a) Working Committee will prepare the progress report of Group every three month. This report will be submitted to local officer.

27. Complaint: Working Committee will complain or go for legal case against any member of Group if he/she is involved in financial fraud.

28. Management of staff

a) Group will appoint staffs in contract basis to meet the need of running office systematically.

b) Working Committee will form a committee of five members in co-ordination of General Secretary to appoint the staff. The other functions of this committee will be as assigned by the Group.

29. Inactiveness/Passivity

a) This statue, if contrary to Nepalese Law will be inactive to the extent of contradiction.
